RULES AND REGULATIONS FOR ADMITTANCE TO THE TIME SHARE OWNERS ASSOCIATION RECREATION CENTER Definitions. The terms defined in these Rules and Regulations (except as may be otherwise expressly provided in these Rules and Regulations or unless the context otherwise requires) shall, for all purposes of these Rules and Regulations, have the following respective meanings: "Rules and Regulations" means Rules and Regulations adopted and promulgated from time to time by the Member Associations, including any schedules to these Rules and Regulations all relating to the possession, use and enjoyment of the Time Share Owners Association Recreation Center. "Member" means a person reflected in the required records of the Time Share Owners Associations as the Owner of Record of a time share interval of a Member Association. "Member Associations" means Breezy Point International (Chalet) Time Share Association, Inc., Breezy Center Time Share Owners Association, Inc., Pelican Greens Owners Association, Inc., Pelican Pines Time Share Association, Inc., Pelican Bay Owners Association, Inc., Pelican Woods Owners Association, Inc., High Village Time Share Owners Association, Inc., Point Condominium Time Share Association, Inc., Point Place (Condo 1010) Time Share Owners Association, Inc., Pelican Shores Time Share Owners Association, Inc., and Marina Bay Time Share Owners Association, Inc. "Ownership Documentation" means group, corporation or business ownership must provide a copy of their deed or shareholder statements to their Time Share Association for promulgation of the record of fixed owners. "Owners of Record" means the grantee or grantees named in each original deed of an undivided fee ownership interest in a time shared unit together with the exclusive right to use and occupy the time shared unit for a specific interval duly filed in the Office of the Registrar of Titles, Crow Wing County, Minnesota.
Fixed List of Owners of Record" means a non-rotating list of owners in situations where owners of record exceed the maximum occupancy of a time share unit. "Unit Maximum Occupancy" means a one-bedroom unit not to exceed four (4) persons, a two-bedroom unit not to exceed six (6) persons, and a three-bedroom unit not to exceed (8) persons per interval usage. 1. Only owners of time share intervals of Member Associations who are current on all dues, taxes, and assessments and are Members in good standing shall be eligible for admittance to the Time Share Owners Association Recreation Center. 2. Owners of time share intervals of Member Associations usage shall be allowed only if their Member Association is current on all dues, taxes, assessments and capital contributions as stated in the Member Control Agreement and Lease/Buy Agreement with Pelican Development of Breezy Point, LLC. 3. Admittance shall be by pass card only which shall be issued at the Breezy Point Time Share front desk when proper identification of ownership and qualifications have been certified. 4. Ownership listings of qualifying time share owners shall be the responsibility of each Member Association and/or its management company. In the case of multiple owners of an interval or corporate ownership of an interval, it shall be the responsibility of these owners to provide their Associations with documentation necessary to meet these Rules and Regulations. 5. No transfer of pass cards or privileges will be allowed. 6. Ownership usage shall be year round and shall fall into one of the classes named below: A. Normal Interval Usage: Usage incurred for the interval owned for the occupants of said unit be they owners, renters, or the resulting trade of said interval through any formal trading format, i.e. RCI. a. This usage shall not exceed the maximum occupancy of said unit or the unit being occupied in the event of a formal trade. If an owner rents or trades all or part of an interval to any party that does not check in at the Breezy Point Time Share front desk, it shall be the responsibility of that owner to provide Breezy Point Time Share front desk with the information necessary for these parties to obtain a usage pass card. B. Extended Interval Usage: Usage of extended intervals at times other than owned intervals shall fall into one of the following three categories: a. Single persons or single-family ownership. This usage shall be restricted to the owner, owners and their children when accompanied by the owner. b. Group or multiple-family ownership. This usage shall be restricted to a fixed list of owners of record and shall not exceed the maximum occupancy of said unit. This usage shall be restricted to owner, owners and their children when accompanied by the owner with daily usage not to exceed the maximum occupancy of said unit. c. Corporation or business ownership. This usage shall be restricted to a fixed list of owners of record of said corporation or business. This list shall not exceed the maximum occupancy of said unit. Under any of the above ownership structures, extended usage is a non-cumulative privilege to the owner, no matter how many interval/weeks owned. 7. The facility users shall abide by all posted rules and regulations in the building. Amendments. The member Associations may adopt, amend or repeal these Rules and Regulations. Captions. The captions herein are inserted only as a matter of convenience and for reference, and in no way define, limit or describe the scope of these Rules and Regulations, or the intent of any provisions hereof. Gender. The use of any gender in these Rules and Regulations shall be deemed to include either or both of the other genders and the use of the singular shall be deemed to include the plural whenever the context so requires. Interpretation. The provisions of these Rules and Regulations shall be construed to effectuate the purpose of creating a uniform plan relating to the Time Share Owners Association Recreation Center. Management shall enforce these Rules and Regulations to ensure the safe and unobstructed enjoyment of the owners during their usage of the facilities. Waiver. No restriction, condition, obligation or provision contained in these Rules and Regulations shall be deemed to have been abrogated or waived by reason of any failure to enforce the same, irrespective of the number of violations or breaches thereof which may occur. Severability. The provisions hereof shall be deemed independent and severable, and the invalidity or partial invalidity or enforceability of any one provision shall not affect the validity or enforceability of any other provision hereof. Counterpart Copies. For the convenience of the parties, these Rules and Regulations have been executed in Counterpart Copies, which are in all respects similar, and each of which shall be deemed to be complete in itself so that any one may be introduced in evidence or used for any other purpose without the production of the other counterparts. Governing Law. These Rules and Regulations shall be governed and construed under the laws of the State of Minnesota, and any suits or arbitration must be venued in the State of Minnesota. |
